typically when recording a band without a label, who owns the master tapes? who owns the multitrack tapes?

Once they've paid their bill for the recording the band owns the master. I always tell the band that the masters (multitrack and mixes) remain property of the studio/engineer/me untill their bill is paid in full. It's the only bargaining tool you have.
Once they've paid they can take their tapes.

One piece of advice: PUT THAT IN WRITING! You DON'T own ANYTHING belonging to your client unless they agree that you do!

Quite true, but who is the master's master?


BTW, David Bowie owns his masters, but I seem to recall he's one of the few in the big rock world.

without a contract of any sort, the real answer is, the person who owns the master is the person who has the most money to pay a lawyer to bring the case to court. really. Its positively foolish to get involved in a recording situation without a contract. Its foolish for the studio to book a band without a contract and its foolish for a band to enter a studio without a contract. The word "contract" is scary, you can write it on a napkin and sign it and its done, and all it needs to say is "all masters are property of the studio until the rate of X per X days booked is payed in full at which point ownership is transfered to X". I wouldnt allow anyone in my place that was uncomfortable signing that and as a musician I would NEVER EVER record anywhere that wasnt willing to lay out intellectual rights on the stuff generated under their roof. Now, if you dont have that contract on a napkin and it does go to court, generally the more expensive lawyer wins. Napkin you can get for free at a restaurant and you probably already have a pen close to your console...
