I've already got one d12, but have been wanting another so bought one. An md441 showed up instead. First impression is me likey.

As far as ethics though, as an avid ebayer myself, I would recommend letting the seller know about it.
Tempting though to stay mum and keep that puppy.

Well, I messaged the seller the next day. Started putting the Senn thru the paces. Three days later sent another message. No reply. After a week I initiated a return. No reply. Escalated the return. No reply. Ended up getting a full refund.

Sounds like you're obligated to send it back then. You initiated a return and got a refund. Not sure they'll be too happy if they don't get the mic back. The seller may be bad with communicating (stupid on their part), but it sounds like you're on the hook. I could be wrong.

If it's like my experience, when the seller doesn't respond to a request for return, it's Ebay that refunds you the buyer, and you can keep the item.
In my experience, that has happened when the item was expensive to ship and defective, or the seller is a douche and fighting about it. Or, as apparently here, the seller ignores the request for return in violation of Ebay's rules.
At that point, Ebay takes over and refunds, and you as the buyer are done, with no further obligation; Ebay may or may not go after the seller for what they refund, but Ebay doesn't want the item.
So, floid made out like a bandit, but isn't one!

Thing is, I have to imagine that if Ebay pays on such an issue, they want to get their money back from the seller. Didja check and see if the seller is still in good standing? I suspect this kind of issue is also related to the occasional seller who bitches that Ebay holds the sale money.
"Amateur" is not always an insult, but when someone is trying to function as a purveyor of merch but then doesn't follow up, it's on them.
